LAS VEGAS, Nev. (FOX5) – The family of a woman who drowned in a Las Vegas Athletic Club pool has filed a wrongful death lawsuit against the gym.

The lawsuit, filed in Clark County District Court on Wednesday morning, alleges that LVAC was negligent in the death of 58-year-old Leticia Triplett and did not take the proper precautions to prevent drownings like hers.

In June, the Southern Nevada Health District revoked a waiver granted to LVAC that allowed it to monitor pool areas with surveillance cameras rather than a trained lifeguard. The district said in a release that Triplett’s death was a major factor in the decision.

The district also highlighted surveillance footage of Triplett swimming in the pool before suddenly “kicking erratically” and appearing to have trouble keeping their head above water. She could also be seen “flailing, splashing, and rolling in the water” before floating motionless for another ten minutes.

The lawsuit alleges that the gym fostered “dangerous conditions” that led to Triplett’s death and did not “exercise reasonable care” to avoid such incidents.

LVAC also filed a lawsuit against the district in June, claiming that the district did not provide proper notice of new pool regulations or give the gym enough time to accommodate.

Last Wednesday, LVAC sent an email to members stating it was forced to close its pools at every location by the health district. LVAC CEO also noted that discussions with the district regarding the closure are ongoing, and he hopes to come to a new agreement with them soon.

FOX5 has reached out to LVAC for comment on the lawsuit but has yet to hear back.
