LAS VEGAS, Nev. (FOX5) – The Clark County District Attorney has officially filed a petition calling for a Clark County School District Board of Trustee’s seat to be vacated.

The petition, filed Wednesday, calls to declare Katie Williams’ seat vacant, alleging she’s no longer a resident of her district or of Nevada.

“Petitioner [DA] believes that Respondent [Williams] has been living in the State of Nebraska, intends to remain in Nebraska and that her actions show she intended to abandon her residence in Nevada,” the petition reads.

The DA also acknowledges that a letter was sent to Williams on Sept. 4 ordering her to respond to the call to vacate her seat.

“As of the date of this filing [9/11], Respondent Williams has not relinquished her office as CCSD Trustee of District B, therefore, Petitioner shall commence and prosecute in a court of competent jurisdiction, any proceedings or judgment and decree declaring such office vacant, wherefore, Petitioner brings this petition to declare vacant the Office of School Board Trustee, District B,” the petition says.

No hearings have been scheduled, according to court records.

CCSD released this statement:

The Clark County School District Board of School Trustees is aware of the District Attorney’s petition to declare District B vacant due to Trustee Williams’ alleged residency. Unless the seat is declared vacant by a court of law or resignation, the elected representative remains as trustee. Resignation or removal from office does not affect any prior votes or actions taken by the Board.

Should a vacancy occur, Governance Policy-19 addresses vacancies and the process the Board follows for a replacement.

The CCSD Governance Policy states that the board will do the following:

  • Position will be posted
  • Candidates will be interviewed for the open position during a public meeting by the board of trustees
  • Board will vote on who to fill the spot, again during a public meeting
