LAS VEGAS (FOX5) — The American Civil Liberties Union of Nevada (ACLU) has appealed its lawsuit against LVMPD’s 287(g) agreement with ICE to the state’s Supreme Court.
In a release Wednesday, the ACLU stated that they are continuing their fight to compel LVMPD to share details of their agreement in order to “hold law enforcement accountable for exceeding their authority under Nevada law.”
Attorneys with the ACLU are petition the Nevada Supreme Court to review a March 6 decision by the Eighth Judicial District Court that dismissed their initial case on procedural grounds. The organization contends that the decision never clarified if the agreement between LVMPD and ICE violates Nevada law.
The lawsuit also centers around a supplement to their initial case, which involves LVMPD allegedly handing one of the ACLU’s clients over to ICE days after a lawsuit was filed on his behalf.

The client, Sergio Morais-Hechavarria, is now in Texas under a federal immigration hold, according to the ACLU. They told FOX5 back in October that the transfer “not only violated his rights, but also undermines the authority of Nevada’s judicial system.”
“As promised, we will continue to pursue all challenges to ensure our local and state governments are following the law, including when local authorities unlawfully support the federal government’s mass deportation efforts and undermine civil liberties in the process,” said ACLU of Nevada executive director Athar Haseebullah. “In Nevada, local law enforcement agencies do not have the legal authority to enter into 287(g) cooperation agreements with DHS. The authority to do so comes from the Legislature. Nevada law limits what local agencies can and cannot do, and we will fight to ensure the government follows the law as well. Nevadans deserve a ruling in this case on the merits, and we will continue to push relentlessly to ensure we receive one.”
LVMPD has previously declined to comment on pending litigation.
