LAS VEGAS (FOX5) — A federal appeals court has ordered changes to an ongoing injunction that has limited fines and citations for illegal short-term rentals across Clark County.

The Ninth Circuit Court of Appeals issued a memorandum to narrow the scope of the injunction, sending the matter back to District Court. Clark County sought to fight the injunction through the appeal process.

Clark County has faced limits on short-term rental enforcement due to an injunction issued in federal court in December: a judge granted an emergency injunction to pause fines and citations after homeowners and Airbnb argued in a suit that regulations they deemed draconian were unconstitutional.

In court documents, the judges indicate that Clark County could reopen the application portal for short-term rental licenses if the scope of the injunction were narrowed; documents suggest that applicants could possibly be exempt from certain penalties while their applications are reviewed.
