LAS VEGAS (FOX5) — Nevadans voted to pass Question 6, a ballot measure on reproductive health that protects abortion rights and broadens the definition of reproductive freedom in the state.

The question passed with more than 63% of the vote.

Abortion was already legal in Nevada, and the vote makes it a constitutional right.

What Question 6 does

Question 6 adds a new section to the Nevada Constitution.

Abortion in Nevada was legal with a 24-week cutoff. With Question 6 passed, the standard is determined by fetal viability. A treating health care provider decides if a fetus has a significant chance of surviving on its own without extraordinary medical measures.

Kortney Olsen describes her decision

Kortney Olsen was 21 when she became pregnant. She said she was battling a drug addiction and made a decision she thought was best for her.

“I was on birth control and still attempting to go through college and do everything despite this addiction,” Olsen said. “And I still wound up getting pregnant.”

Olsen said the termination came at “the eight-week mark.”

“I believe, if memory serves, that I had a medical termination,” Olsen said. “Had I not, that child would have been born with a severe drug addiction. And I was still a child myself.”

“That decision would have changed the entire trajectory of my entire life,” she said.

Opponents respond

Opponents say the new language opens the door too wide.

Krystal Minera-Alvis of Nevada Right to Life said babies are seen as early as 20 weeks in hospitals.

“We see babies as early as 20 weeks on one floor of a hospital fighting for [their] lives,” Minera-Alvis said. “And in this case, they will now be at the hands of an abortionist.”

Minera-Alvis said the fight is far from over.

“We will continue the fight for life,” she said. “We’re going to continue to lobby in the legislature.”

What happens next

Question 6 officially becomes part of the Nevada Constitution on Nov. 24, once the state Supreme Court certifies the election results.

Because Question 6 is an amendment to the state constitution, any future effort to change or restrict abortion access in Nevada would require another multiyear statewide vote.
