LAS VEGAS (FOX5) — Voter identification will be required at the ballot box in Nevada after voters approved Question 7 in the midterm election, officially amending the state constitution.

Under Nevada law, citizen-initiated constitutional amendments must pass in two consecutive general elections. Question 7 passed in 2024 and won approval again in the midterm election with more than 60% of the vote in favor.

Accepted forms of photo ID

In future Nevada elections, acceptable forms of photo ID include:

  • A driver’s license
  • A state- or federally issued ID
  • A government employee photo ID
  • A U.S. passport or military card
  • A student photo ID issued by a Nevada public college or university
  • A Nevada concealed firearms permit

When the amendment takes effect

Bradley Schrager, a Nevada political and election law attorney, said the amendment takes effect at the end of November and will apply to future elections.

“Well, it will become effective in Nevada at the end of November. So it will apply to any elections from here on out. There’s going to be some things that the legislature is going to have to do, because to make this constitutional, everyone has to have free access to an ID,” Schrager said.

Schrager said carrying out the requirement will take an investment.

“What’s unconstitutional is what’s called a poll tax,” Schrager said. “And it goes back to the sort of 19th century after the Civil War, in which people would be essentially either made to pass a test or charge money to register to vote. It’s unconstitutional to charge people or to make them pay money to exercise their constitutional right to vote as Americans.”

Mail-in voting

Photo ID will not be required for mail-in voting.

The amendment requires mail-in voters to verify their identity by entering either the last four digits of their driver’s license number or their Social Security number. If a voter has neither, the county clerk will provide a number at registration.

The amendment says mail-in voters must place the last four digits in the box next to the signature on the ballot, where election officials can verify it.
