LAS VEGAS, Nev. (FOX5) -The Clark County School District Board of Trustees on Thursday approved a $1,000,000 settlement with two students who got in a confrontation with CCSD Police Department officers back in 2023 near Durango High School.

CCSD Police Lieutenant Jason Elfberg is seen in video slamming one student to the ground. The American Civil Liberties Union of Nevada represented the two students in a civil lawsuit.

On Friday the ACLU said the students, now a junior and senior, will use part of the money to go to college. But it’s unknown if they will attend college in Nevada. The ACLU says one of them doesn’t feel safe after what happened.

“One common concern is the fear. Whenever they should see a police officer, fear of blue and red lights. Looking over their shoulder when there’s an officer there. These are all natural reactions that occur when a trauma incident like this happens. And that fear is going to continue to linger for some period of time,” said ACLU Executive Director of Nevada Athar Haseebullah.

Haseebullah says the students feel partially vindicated by the settlement but are still frustrated when it comes to accountability. He says Lt. Elfberg should have been fired and prosecuted but no action was taken against him.

CCSD has never said why the officers approached the students in the first place. The district has only said officers were checking out reports of a gun near campus. No gun was found.

FOX5 reached out to CCSD on Friday and requested an interview with Lt. Elfberg.

CCSD refused to comment Thursday night after the CCSD Board of Trustees voted unanimously to accept the $1,000,000 settlement amount.

Haseebullah says whether or not the district accepts responsibility, a million-dollar settlement speaks for itself.
