LAS VEGAS, Nev. (FOX5) – The attorney representing Duane “Keffe D” Davis has filed a motion to dismiss all charges related to the Tupac murder case.
In a statement sent to FOX5, attorney Carl Arnold claims that Davis’ constitutional rights have been violated due to “a 27-year delay in prosecution, lack of corroborating evidence, and failure to honor immunity agreements granted by federal and local authorities.”
The charges stem from the 1996 drive-by shooting that killed rap legend Tupac Shakur near the Las Vegas Strip. Police arrested Davis in September 2023, pointing toward old interviews and a memoir where he claimed to order the killing.
He has been in custody since.
Arnold has previously claimed that Davis’ statement was not truthful. In the filing, he further claims that the delays have caused “irreparable harm to Mr. Davis’ ability to defend himself.”
He continues, “Key witnesses are deceased, and critical evidence has been lost, significantly impairing the fairness of any trial.”
In June, Davis attempted to post bond with the help of an outside source, but the effort was denied after Judge Carli Kierny questioned the source of the money.
FOX5 has reached out to the District Attorney’s office for a response to the filing.
Court records show Davis is due back in court on Jan. 21 to address the filing. His trial remains set for March.
