LAS VEGAS, Nev. (FOX5) – The City of Las Vegas says it has officially filed criminal charges against the man who filed a lawsuit against the city’s marshals.
Derek Myers filed an illegal traffic stop lawsuit against the city after an incident on January 9 near Craig Road.
During the stop, the lawsuit claims a marshal drew a handgun, made threats with a stun gun and slammed him into the ground. He claims he was unlawfully detained and marshals violated his civil rights.
Myers was cited not stopping at a stop sign or emergency lights and obstructing and resisting.
The plaintiff accuses the City of Las Vegas’ deputy marshals of negligent training and supervision, intentional infliction of emotional distress, battery and assault, false arrest and imprisonment, and violation of the constitution.
He’s seeking about about $1 million for damages.
The city filed criminal charges against Myers Monday. He faces DUI, reckless driving and failure to provide insurance upon demand.
The city said Myers showed signs of impairment while performing sobriety tests. Toxicology reports obtained by the city allegedly showed controlled substances in Myers’ system.
Earlier in May, the city asked federal courts to dismiss a lawsuit that accused its marshals of illegal traffic stops.
