
LAS VEGAS, Nev. (FOX5) – A Las Vegas man who stabbed another man up to 40 times was sentenced to probation.
On Monday, Judge Danielle Pieper sentenced Dylan Ihmels to probation, not to exceed five years. If Ihmels violates his probation, he could face 5-12 years in prison.
An arrest report from August 2023 states Ihmels stabbed the victim 30-40 times. He was originally facing attempted murder charges but it was later downgraded to battery with use of a deadly weapon.
In March, Ihmels pleaded guilty but mentally ill.
“When I first saw this and I read the PSI [pre-sentence investigation report] I agree it was a pretty violent case but because I’ve worked with both of the parties standing in front of me I’m going to trust their judgement,” judge Danielle Pieper said.
The state along with defense attorney Joshua Tomsheck agreed to terms that would allow Ihmels to serve out his sentence which focuses on his mental health.
Tomsheck sent the following statement to FOX5 :
While on the surface, this is an uncommon resolution in a case with these types of charges, it was a specifically tailored negotiation, given the unique circumstances of Dylan and his situation. This case is the result of a mental health crisis involving an individual who was off of his medication through no fault of his own. Dylan is not, by nature, a criminal or a violent person. The sentence, which was carefully crafted and agreed upon by the parties and imposed by the court, allows for long-term monitoring of Dylan, his mental health, and his ongoing care. He will be on an extended period of probation with specifically tailored requirements, which are given to those of a mental health specialty court. Through this resolution he will receive the treatment that he needs, and the education and oversight to ensure there are no issues in the future.
FOX5 featured Ihmels in a story in March 2024. It highlighted the long wait time “incompetent” inmates who were held at Clark County Detention Center had to endure before being transferred to a state-run mental health facility.
