LAS VEGAS, Nev. (FOX5) – A lawsuit has been filed against the City of Las Vegas after their approval of a proposal to build a new LDS Temple near Lone Mountain.

The suit, filed on behalf of a group called the “Nevada Rural Preservation Alliance,” say they are property owners living near the site where the temple is set to be built. The Church of Jesus Christ of Latter Day Saints is planning to build on 20 acres off of Alexander and Grand Canyon.

After months of debate, last month he City of Las Vegas approved the project with some design modifications to the 70,000 square foot temple including to the height limiting it to 196 feet.

In the lawsuit, the petitioners claim: “the City of Las Vegas abused its discretion” and “made errors of law” including the “construction application.”

The suit also says back in 2003, the City of Las Vegas denied a request for a 77 foot cross at Canyon Ridge Church because it exceeded a 35 foot height requirement. The suit claims in 2009, the city also denied the International Church of Las Vegas an 85 foot prayer tower.

FOX5 got a copy of the lawsuit late Monday. FOX5 did reach out to the City of Las Vegas for a response but have not heard back so far. FOX5 also reached out to the attorney who filed the suit on behalf of neighbors and have yet to receive a response.
