LAS VEGAS, Nev. (FOX5) – Tuesday, Station Casinos filed a lawsuit saying the National Labor Relations Board lacks authority to prosecute claims against them.

Station Casinos says they seek a temporary and permanent injunction to stop any pending proceedings against them.

In the lawsuit, Station Casinos says the NLRB‘s structure is unconstitutional. They challenge the NLRB’s right to deprive the company of a jury trial and act as a prosecutor, judge and jury in the same case.

Station Casinos wants to halt a case brought by the NLRB in 2021. The board filed a nearly 100-page complaint against Station Casinos filled with allegations dating to 2018.

Station Casinos says the board also joined the Las Vegas Culinary Union’s campaign, causing thousands of investigative requests.

The company says the NLRB failed and threatens to rid the employee’s right to choose if they want to be part of a union or not.

Station Casinos says their employees at all, but one, have rejected the culinary union.

FOX5 received a statement from the Las Vegas Culinary Union about the lawsuit.

The union says Station Casinos filed the lawsuit for corporate interest over the rights of workers.
