LAS VEGAS (FOX5) — The man accused of killing an 11-year-old boy in a road-rage shooting in late 2025 will not see his murder charge reduced, a Clark County judge ruled Tuesday.
At a March 24 hearing, a local judge denied a defense request to remove part of the state’s case. The petition, filed January 30 by the attorney for Tyler Matthew Johns, argued there was not enough evidence to support the state’s child-abuse felony murder theory tied to Count 1 (open murder).

The filing adds that Johns, now 23, did not know a child was in the other vehicle when a single shot was fired on the 215 Beltway in November, killing Brandon Dominguez-Chavarria.
Prosecutors, in a response filed March 10, asked the judge to dismiss the petition, arguing the state only needed to show probable cause at the preliminary hearing and that Nevada law allows multiple theories to go before a jury.
With the petition denied, the case will proceed as filed, with trial currently set for November 9.
