CARSON CITY, Nev. (KOLO) -Nevada Attorney General Aaron Ford said Saturday his office has appealed the dismissal of criminal charges against Nevada’s fake electors to the Nevada Supreme Court.
Clark County District Court Judge Mary Kay Holthus in June said she was dismissing criminal charges against six people selected in 2020 to cast electoral votes for Donald Trump even though Joe Biden won Nevada’s presidential election.
Holthus said the case should not have been filed in Clark County. Her written decision was filed Friday.
Ford issued his statement on Saturday.
“My Office has appealed the dismissals to the Nevada Supreme Court,” Ford said. “We remain confident in our case and look forward to bringing these individuals to justice and holding them accountable for their actions.”
The Nevada Republican Party praised the decision by Holthus in June.
The defendants are state GOP chairman Michael McDonald; Clark County GOP chairman Jesse Law; national party committee member Jim DeGraffenreid; national and Douglas County committee member Shawn Meehan; Storey County clerk Jim Hindle; and Eileen Rice, a party member from the Lake Tahoe area.
They faced charges of offering false instruments for filing on record and uttering forged instruments.
They were scheduled for trial in January.
Monti Levy, one of the defense lawyers, said Saturday they “are confident that Judge Holthus made the correct decision and that her order granting the motion to dismiss will be upheld.”
The defense attorneys had argued that Ford improperly brought the case against their clients before a grand jury in Democratic-leaning Las Vegas instead of in a northern Nevada city, where the alleged crimes occurred.
is one of seven presidential battleground states where slates of Republicans falsely certified that Trump, not Biden, had won. Others are Arizona, Georgia, Michigan, New Mexico, Pennsylvania and Wisconsin.
