LAS VEGAS (FOX5) — Nevada is leading a lawsuit with 21 other states challenging President Donald Trump’s executive order aimed at restricting mail-in voting and creating a nationwide voter list.

Attorney General Aaron Ford and Secretary of State Cisco Aguilar, said the president’s action is unconstitutional.

“The notion that the federal government must get involved in local state processes is a direct attack on Nevadans’ constitutional right to vote,” Ford said.

Executive order details

Trump signed the executive order earlier this week. The order puts the Department of Homeland Security in charge of building a nationwide list of verified, eligible voters. It would also block the U.S. Postal Service from sending absentee ballots to anyone not on a state’s approved voter list.

“I don’t know how it could be challenged,” Trump said.

The president said the order is about voter integrity.

“Remember, it’s about voter integrity. We want to have honest voting in our country because if you don’t have honest voting, you can’t have a nation,” Trump said.

Timing concerns

Aguilar said changing rules during an election year creates problems for voters.

“All of a sudden, you make it to the championship or World Series, and all of a sudden rules are different — fans would go absolutely nuts, and it’s the same in our election. Voters deserve consistency,” Aguilar said.

Trump has threatened consequences for states that don’t comply with the order. Aguilar said the executive order contains no funding.

“This is an unfunded mandate on local governments and state governments,” Aguilar said.

Governor’s position unclear

Gov. Joe Lombardo has not said whether he will side with Ford and Aguilar.

His office said in this statement, “The Governor believes elections should be run by the states but supports common sense reforms to Nevada law that strengthen the integrity of our elections. He led the effort to put voter ID on the ballot and has called for ending universal mail ballots, believing only registered qualified military, or voters who request a mail ballot, should get mail ballots.”
