LAS VEGAS, Nev. (FOX5) – Local Republican groups have filed a lawsuit against the Nevada Secretary of State, disputing the counting process for mail-in ballots.
In a lawsuit obtained by FOX5, the groups claim that counting mail ballots without a postmark, or ballots with an undetermined postmark date are not permitted to be counted, according to Nevada law.
When asked for comment, the Secretary of State’s office declined to comment about this lawsuit.
However, they provided a copy of the law mentioned in the suit, which highlighted the following:
It also told us that the United States Postal Service is responsible for postmarking all mail-in ballots that come through its facilities since all ballots are considered first-class mail.
