LAS VEGAS (FOX5) — A Nevada state senator is disputing a DUI charge after he was arrested Friday, saying he wasn’t drunk — just tired.
According to an arrest report, Edgar Flores was found near the intersection of Lamb and Lake Mead boulevards, slumped over in the driver’s seat and appearing to be asleep.
Flores, a Democrat representing District 2, was first elected in November 2022.
Another officer arrived to assist. That officer tried to wake Flores, which he eventually did, but Flores “appeared confused and disoriented, looking side to side without focus,” the report said.
In a statement, Flores said he had been tired after a long day of work, community events, evening exercise and a late dinner.
An officer reported that Flores’s speech was soft and delayed, his eyes were droopy, and there was a slight smell of alcohol. According to the report, Flores admitted to drinking one beer around midnight. The incident occurred around 4 a.m.
The report stated Flores performed standardized field sobriety tests “unsatisfactorily.”
In the statement, Flores said he voluntarily submitted to a breathalyzer and a blood test at the police station.
“The breathalyzer confirmed a 0.00 BAC, and we are confident the blood test will confirm the same,” the statement said. “While he and his team respect the officers’ diligence in ensuring public safety, our campaign is also reviewing whether his rights and privacy were properly respected.”
