LAS VEGAS, Nev. (FOX5) – A new class action lawsuit is accusing the City of Las Vegas and its peace officers of conducting “unlawful arrests” outside their legal jurisdiction.

The lawsuit, filed in US District Court Thursday, accuses city marshals of “a systemic pattern of unconstitutional and unlawful conduct.”

The lawsuit also claims they “repeatedly and willfully” pulled people over, searched, detained, and arrested people outside of the marshals’ jurisdiction.

The 16-page lawsuit filed by attorney Adam Breeden on behalf of Derek Myers claims the case stems from a January 9 incident. Myers says he was pulled over by marshals on I-11 near Craig Road for “speeding and following too closely.”

The complaint said the two marshals searched Myers and his car “without consent of a warrant,” did a “faulty” DUI test, and arrested him. Myers was held in jail for 17 hours before he was released.

According to the lawsuit, no criminal charges have been filed against Myers.

The complaint says “Myers became one of hundreds if not thousands of victims of a rogue law enforcement agency brazenly operating outside its legal authority.”

It seeks more than $1 million in damages for battery, false arrest, and the violation of Myers’ 4th and 14th Amendment rights, which involve unlawful search and seizure and false imprisonment.

FOX5 has reached out for comment from the city, but has yet to hear back.
