New Nevada law allows construction to begin as early as 5 a.m.

LAS VEGAS (FOX5) — If you live near a construction site, you may be getting an early wake up call. Last month, the governor signed a law allowing work to begin as early as 5 a.m.

Near one major construction site across from Lake Las Vegas where an old mine is being cleaned up to make way for hundreds of homes, neighbors have noticed the earlier start.

“They are not starting at 7:00, more like 5:00 am,” wrote one neighbor on social media.

“Dang they are so loud so early! Woke me up before 6:30… Did they follow the noise ordinance of 7am?” wrote another.

Laws have changed since the project began shifting legal construction hours.

Last month, the governor signed a law allowing work to begin as early as 5 a.m.(FOX5)

Assembly Bill 478, which passed both the Nevada Assembly and Senate unanimously, allows construction work throughout the state to begin as early as 5 a.m., from April 1st to September 30th each year.

It’s an effort to protect workers from extreme, deadly heat allowing them to begin work earlier before temperatures peak. For the 5 a.m. start time to apply, the construction work must be at least than 300 feet away from any occupied home.

Last month, after the bill was signed into law by the governor and immediately went into effect, an informational session was held and workers, (who asked not to be identified), shared their experiences explaining why the new law was so desperately needed.

“I will go out there working the heat, come back and I pass out. I pass out for three or four hours,” the worker explained. In 2024, 526 people in Clark County alone died due to heat-related causes.

Nevada OSHA also began to enforce new protections for workers during extreme heat in April of this year.
