
LAS VEGAS (FOX5) — A Las Vegas judge has ruled that a 19-year-old accused of causing a 12-car crash that killed 2 will remain in custody without bail.
Jose Gutierrez is facing two murder charges related to the crash. Following the teen’s first court appearance last week, District Attorney Steve Wolfson stated that prosecutors believe he caused the crash intentionally, something his attorneys pushed back on during Tuesday’s hearing.
Instead, Gutierrez’s attorneys say that he experienced a medical episode before the crash, pointing to his history of seizures from a young age and his lack of memory in the crash. They say they plan to collect the teen’s medical records to better illustrate their argument.
Prosecutors contend that Gutierrez intentionally caused the crash to kill his girlfriend, Adilene Duran-Rincon, who was 11 weeks pregnant at the time, according to police. The state also countered that if the teen was regularly experiencing medical episodes, then he would not be able to drive.

Judge Bonaventure ruled that Gutierrez would continue to remain in custody without bail.
FOX5 talked with Duran-Rincon’s brother after the hearing. He recalled how much joy she brought to the family.
“She was happy,” Isaias Duran reminisced. “She’d always tell jokes with us.”
Duran said if it was a seizure that caused the death of his sister, then Gutierrez should not have been driving. He’s looking forward to learning whether or not that’s what actually happened.
“I want justice — to figure out what happened before the accident. What happened before,” he said. “That’s the only thing I want to know.”
Duran would have been a first-time uncle next year had his sister and her unborn child survived.
Gutierrez is due in court again on Dec. 9 at 9:30 a.m.
