LAS VEGAS, Nev. (FOX5) – A federal judge dismissed wire fraud charges against a Nye County sheriff’s captain that’s accused of wrongfully arresting a CEO of a power company.
Prosecutors have filed for the court to reconsider the charges.
David Boruchowitz faces six charges. It stems from the arrest of Angela Evans. She was the CEO of the Valley Electric Association. It’s responsible for providing power to residents of Nye County.
According to court documents, Boruchowitz’s arrest of Evans was done without a warrant and lacked probable cause.
Prosecutors accuse him of fraudulently taking Evan’s job for his personal gain to obtain a position on the VEA board.
The indictment details the alleged scheme Boruchowitz carried out.
On Dec. 18, a judge dismissed counts two to five of wire fraud. Early January, prosecutors filed a motion to reconsider the dismissal.
A trial is scheduled for March 24, 2025 at 9 a.m.
