LAS VEGAS, Nev. (FOX5) – Prosecutors won’t seek the death penalty against a woman accused of killing her neighbor, a North Las Vegas pastor, after an ongoing home owner’s association dispute.
Joe Junio faces murder, attempted murder, battery and child abuse charges after allegedly shooting 46-year-old Nick Davi in front of his two children, ages 12 and 15, in Dec. 2023. The mother, Sarah Davi, was also shot but survived. Court records from a Thursday hearing show prosecutors don’t intend to seek the death penalty.
Junio pleaded not guilty, according to court records.
Court documents report the neighbor confronted the pastor and his family in front of his home after he made complaints about her to their homeowner’s association. Though the lawsuit does not name the HOA it says quote: “The homeowner’s association knew or should have known that Defendant would likely perform violent actions against deceased and Plaintiff as a result of on-going association dispute.”
The lawsuit also claims Junio did not have a license or permit to carry a firearm, that she borrowed it from someone.
Junio’s next court hearing was set for March 26.
