RENO, Nev. (KOLO) – An August 2022 shooting of a man by officers with the Reno Police Department has been deemed justified under Nevada law by the Washoe County DA’s Office.

Brandon Douglas Allen was shot by police on Aug. 8, 2022.

The incident began at around 10:00 a.m. that day when physical therapist Patrick Devlin arrived at a residence to provide in home care to the resident.

At the same time, a contractor was also present at the home performing work on a fence. While outside, the contractor noticed a heavily tattooed man later identified as Allan in the backyard near the fence line. The contractor noticed Allan was carrying a large knife and had a handgun in his waistband and witnessed him stabbing or jabbing the knife at the fence.

Allan then confronted the contractor and told him he needed to get inside because “stuff is going to happen,” prompting the contractor to retreat inside, inform the homeowners, and call 911.

An RPD officer arrived, spoke with the homeowner and observed Allan outside the home. The officer went outside and began issuing commands to Allan to drop the knife. Allan did not comply, acted erratically and continued to pace in the street area near the residence.

Another officer arrived shortly thereafter and joined the first officer in ordering Allan to drop his knife. The DA’s office says Allan continued to ignore commands, appeared detached and intermittently shifted the knife between his hands while freeing his right hand near the gun in his waistband.

Allan then began moving away from officers, walking down the cul-de-sac towards homes on Kingfisher Drive. Police then became concerned he could reach civilians or attempt to barricade himself inside a house.

Additional RPD officers arrived just before 11:00 a.m.

Allan then turned back towards two of the officers and appeared to reach for the gun in his waistband, causing one of the officers to fire around four rounds, while another officer fired around three rounds.

Allan was struck multiple times and fell face down. He was taken to Renown and survived the incident.

A records check on Allan found he was on lifetime parole stemming from a prior murder conviction.

Allan was later charged with resisting a public officer with a dangerous weapon other than a firearm.

It was later determined that the weapon carried by Allan was not a gun but was instead a Sig Sauer P226-style pneumatic CO2 handgun.
