BOULDER CITY, Nev. (FOX5) — A federal board is ordering another halt on the construction of the Townsite Solar 2, LLC data center near Boulder City.
In a decision that came down Tuesday morning, the U.S. Department of Interior Board of Land Appeals granted a stay on the Bureau of Land Management’s decision to allow the construction.
Townsite Solar 2, LLC had initially applied to build the center on a city-owned site, but withdrew their application after intense public pushback. Shortly after, they announced plans to build on 80 acres of BLM land instead. Boulder City and local environmental groups appealed the project in July.
The board concluded that the city and groups would likely succeed on the merit of their claims that BLM’s analysis of the project’s environmental effects was “insufficient”. The board also found that environmental groups demonstrated that permanent and irreparable harm is likely to occur to members’ recreational interests at the project site, and that those harms outweigh the harms to Townsite.
Boulder City contends the BLM did not consult with the city or provide adequate opportunity for public input on the approved data center, as required by federal law. The city’s appeal also raised concerns that the site had not followed the National Environmental Policy Act process as required by law.
