LAS VEGAS (FOX5) — Attorneys representing the man accused in a deadly 12-car crash last year told a judge Wednesday morning they need more time to prepare for trial.
Jose Gutierrez is facing multiple felony charges of open murder, attempted murder, reckless driving and battery related to a November crash. According to police, three deaths were reported following the crash, including Gutierrez’s pregnant girlfriend, Adilene Duran-Rincon.
Prosecutors argue that Gutierrez intentionally caused the crash in order to kill Duran-Rincon, while defense attorneys argue that he had a medical episode leading up to the crash.
During Wednesday’s hearing, Gutierrez’s attorney Thomas Moskal told Judge Michelle Leavitt that he was still in the process of collecting medical records and finding a medical expert, and would not be ready for the November trial date.
Judge Leavitt ruled that they would set a new trial date at the next hearing.
Gutierrez is due back in court on Wednesday, Nov. 4.
