LAS VEGAS (FOX5) — A death penalty review committee is expected to share their decision Thursday morning on whether prosecutors can pursue capital punishment against the suspected gunman in the deadly Las Vegas Smith’s shooting.
Alejandro Estrada, 43, was indicted by a grand jury last month of 13 charges, mainly including two counts of open murder and multiple others for discharging a firearm in an occupied building. He is also facing charges of burglary and home invasion related to an incident that happened before the shooting at the victims’ home, according to court documents.

The victims were identified by the Clark County Coroner as Amanda and Victor Frias-Rosas. Police say that Estrada and Amanda were going through a custody battle at the time of the shooting.
Evidence presented to the grand jury included a photo of documents left on the couple’s bodies immediately following the deadly shooting. The document appeared to be a copy of court documents related to the custody case.
Estrada has previously pleaded not guilty to these charges. He is due in court at 9 a.m.
