LAS VEGAS (FOX5) — Governor Joe Lombardo announced Friday that he has directed the Nevada State Police – Highway Patrol to suspend enforcement of the state’s red-dyed diesel restrictions on public highways.
The Governor says the order is contingent on the IRS not imposing penalties when dyed diesel fuel is sold for use or used on the highway, as required by President Donald Trump’s Executive Order.
According to a media release, any administrative fines incurred during the period covered by Trump’s order will be waived by the Director of the Nevada Department of Motor Vehicles, Tonya Laney, pursuant to her statutory authority.
Lombardo’s office says the Nevada State Police – Highway Patrol will continue the enforcement suspension for a sufficient period after the federal order expires to allow residual red dye in fuel systems to dissipate to undetectable levels.
“Nevada will do its part to implement President Trump’s executive order and ensure our state’s enforcement practices align with federal guidance,” said Governor Joe Lombardo. “We want to give Nevadans the opportunity to take advantage of this temporary relief without fear of being penalized for complying with the order.”
Signed October 5, 2026, President Trump’s Executive Order temporarily expands the permitted highway use of red-dyed diesel and provides certain tax relief and penalty protections through December 31, 2026.
