LAS VEGAS (FOX5) — The man accused of a hit-and-run crash that killed a skateboarder made his first court appearance Friday.

Police say Elijah Malone was arrested July 2 after an investigation into a June 5 crash that killed 29-year-old Ivan Aguilera near Oso Blanca Road and Montecito Pointe Drive in northwest Las Vegas. Investigators said a Ram pickup truck hit Aguilera as it traveled south on Oso Blanca Road, and the driver left the scene.

According to an arrest report, a tip from a bystander lead police to find the pickup and eventual lead investigators to the registered owner and Malones arrest.

Prosecutors asked for $200,000 bail and high-level electronic monitoring if Malone is released. Malone’s attorney argued he is not a flight risk, saying he stayed in the area after the crash trying to figure out what he hit and has strong family and work ties. The defense also asked for Malone to be released on his own recognizance.

The judge would later set bail at $100,000, ordering high-level electronic monitoring and limiting driving to only travel to and from work.

Aguilera’s family attended the hearing and called the bail decision unfair, saying Malone should remain in jail as the case moves forward. Aguilera’s brother said the family plans to attend every court date and wants to build community support in his brother’s name.

Malone is scheduled to return to court July 7.
