LAS VEGAS, Nev. (FOX5) – A judge has ruled against the Southern Nevada Health District’s decision to deny the Las Vegas Athletic Clubs an exemption to its lifeguard rule.
Last summer, the health district revoked a waiver that allowed LVAC to monitor the pool areas with surveillance cameras instead of a lifeguard. The district said a key to the change was the drowning death of a swimmer at LVAC earlier that year.
The judge ruled that the gym is a “private club” and the health district can only regulate public pools.

The judge also said the health district’s claim that LVAC’s pools present an imminent health hazard lacked evidence, saying they failed to demonstrate that these pools pose the same drowning risk as deep-water pools.
The argument did not provide sufficient evidence that a lifeguard could have prevented the death. The family of the woman who drowned has also filed their own wrongful death lawsuit against the gym.
FOX5 reached out to both LVAC and the health district for comment on this ruling.
