LAS VEGAS (FOX5) — The parents of a Las Vegas toddler are now suing the shuttered funeral home they trusted to cremate their daughter.
Their daughter, Autumn, died in June of 2024, just weeks after her first birthday. The lawsuit claims McDermott’s Funeral Home held Autumn’s body for more than four months before cremating her, storing her remains in conditions state inspectors described as “deplorable.”

According to the complaint, inspectors had noted issues with a cooler that held several bodies, including Autumn’s. The suit also claims the family never received an identifying metal tag, raising questions about whether the cremains they got back are actually Autumn’s.
Alyssa Serna, Autumn’s mother, spoke about the loss.
“Losing anybody is hard, but losing your child is horrible. She unfortunately drowned, and it was a horrible situation,” Serna said. “I didn’t want to imagine her in a tiny coffin. I didn’t want any of that. I just wanted her home with me.”
The state funeral board revoked McDermott’s license last summer.
