LAS VEGAS (FOX5) — District court heard a motion Thursday to dismiss a wrongful death lawsuit for a teen killed in a DUI crash outside Arbor View High School.
According to the court minutes, Judge Mark Denton denied the motion after hearing from counsel “regarding crosswalk and safety control measures.” The parties present were attorneys for both defendants and McKenzie Scott’s family. The lawsuit was filed in early May.

Scott was hit and killed in a crosswalk outside Arbor View in May last year. Keenan Jackson was sentenced to 8 to 20 years behind bars. According to an arrest report, a breathalyzer showed he was three times over the legal limit of .08.
The lawsuit claims Jackson used Krystal Harris’s car, who was reportedly the registered owner.
The lawsuit claims the City of Las Vegas and CCSD did not take measures to protect pedestrians on North Buffalo Drive, outside Arbor View High School.
Since the lawsuit was filed, CCSD recently announced crossing guards have been added to five Las Vegas high schools. A volunteer organization that started after Scott’s death continues to seek more help to get students to and from school safely.
