LAS VEGAS (FOX5) — The clock is ticking until all non-functional turf must be removed across Nevada, and the Las Vegas Valley Water District has released feedback on proposed rules.

A public hearing is set for December 1, according to LVVWD documents from November 3.

Proposed service rule updates include the following:

  • Irrigation of nonfunctional turf and any other prohibited water uses as forms of “water waste” and subject to existing “water waste fees”
  • Clarify property owner responsibility for unpaid balances

Documents state that 1,400 properties could still have non-functional turf. The LVVWD recommends fees and charges for non-functional turf not be imposed until January of 2028, all to make sure that everyone has the chance to be compliant with state law, a spokesperson tells FOX5.

Tuesday, property owners raised concerns over who ultimately bears responsibility for unpaid balances for water bills.

“Where specifically did the Legislature authorize the district to make an owner personally responsible for a tenant’s debt simply because that person owns the property?” one person commented during the meeting.

Other landlords submitted similar concerns via Business Impact Statements.

A landlord is ultimately responsible for maintenance issues such as water leaks, a LVVWD spokesperson said to FOX5.

The new rules will not be implemented until 2028, giving landlords time to adjust leases to make sure tenants are financially responsible for their bills, the spokesperson said.
