LAS VEGAS (FOX5) — Sen. Edgar Flores was above the legal limit during his arrest on suspicion of DUI on Sept. 12, police said.

According to a release from the Las Vegas Metropolitan Police Department, Flores’ blood alcohol content was 0.082 in a first sample and 0.062 in a sample taken one hour later. The legal limit for driving on a public roadway is 0.08, police said.

According to an arrest report, Flores was found near the intersection of Lamb and Lake Mead boulevards, slumped over in the driver’s seat and appearing to be asleep.

In a statement, Flores said he had been tired after a long day of work, community events, evening exercise and a late dinner.

“The breathalyzer confirmed a 0.00 BAC, and we are confident the blood test will confirm the same,” the statement said. “While he and his team respect the officers’ diligence in ensuring public safety, our campaign is also reviewing whether his rights and privacy were properly respected.”

Police officials noted that Flores submitted to a preliminary breath test before his release from Clark County Detention Center, nearly 12 hours after his first contact with police. His BAC was 0.00 at that time.

In response to the Las Vegas Metropolitan Police Department news release Tuesday, Flores issued a statement:

“Senator Flores and his legal team have not received any information or documentation from Metro. They remain confident that his name will be fully cleared and reaffirm his commitment to working with both the community and law enforcement to ensure transparency and accountability.”

Flores, a Democrat representing District 2, was first elected in November 2022.
