LAS VEGAS (FOX5) — The man accused of stealing a car from a local Wal-Mart parking lot while a passenger was still inside appeared before a judge on Wednesday.
Police arrested 55-year-old Harold Allen on April 11, accusing him of taking a car that was running and parked near Charleston and Decatur.
Investigators say the alleged theft led to a crash that killed the passenger inside the vehicle, later identified as 37-year-old Benito Saragoza.

During Wednesday’s hearing, Allen was arraigned and entered a not guilty plea. Court records also indicate the state is not seeking the death penalty. Allen’s court appearance comes after he was found competent earlier this month.
Allen is scheduled to return to court on July 21.
