LAS VEGAS, Nev. (FOX5) – A judge has ordered that the ex-husband involved in a child custody case that led to a murder-suicide in Summerlin Monday cannot get custody of his children, temporarily.

Dennis Prince, 57, and Ashley Prince, 30, were shot and killed at Prince Law Group in Summerlin Monday morning during a child custody deposition at the law office. Joe Houston, 77, was the accused shooter who eventually turned the gun on himself. Joe was representing his son, Dylan Houston, in the ongoing custody battle with his ex-wife, Ashley.

In a filing made just hours after the shooting, a judge ordered that Dylan Houston would not get custody of his two children, ages 4 and 5. The order specifically references the April 8 shooting “which occurred this morning at the office of Defendant’s counsel.” The order awards custody to one of Ashley’s family members.

The order says the decision to award custody to a third party and not a surviving natural parent “is a temporary determination and order based on the shocking double homicide, and suicide, which occurred on today’s date.”

A new hearing date has been set for April 17 to discuss custody.
