LAS VEGAS (FOX5) — Henderson city leaders took the first step Tuesday toward changing the city’s liquor code to allow sealed to-go alcoholic drinks from restaurants, following a similar change in the city of Las Vegas two weeks ago.
The move comes after Nevada Assembly Bill 375 passed in the state Legislature.

Business leaders cite financial pressure
Restaurant leaders said establishments across the valley have been squeezed by inflation and shrinking margins. Henderson business leaders said a change to the city’s liquor code could affect whether some businesses stay open.
“Many are concluding that they can no longer survive,” said Peter Saba from the Nevada Restaurant Association. “Today’s consideration by the City Council will provide an immediate and meaningful level of relief if and when adopted.”
“Because if people are at home and they want to consume alcohol, it’s better for them to receive their alcohol at home versus get in their car, go to an establishment, drink, and then drive,” said Robert Saucier the owner of Las Vegas Distillery.
Food requirement debated
Assembly Bill 375 does not include a blanket rule requiring the sale of food with to-go alcoholic drinks. The city of Las Vegas’ regulations require that to-go drinks be sold with a meal.
The owner of Las Vegas Distillery spoke against applying a similar rule in Henderson.
“I heard there may be some sort of provision where there might be some sort of food to alcohol ratio on this,” Saucier said. “That was never contemplated in Carson City when the law was passed, and I don’t think it’s necessary.”
Next steps
City staff confirmed Tuesday night that they will draft the to-go drinks language into a new ordinance. The ordinance will return to the Henderson City Council for a final vote later.
If approved, Henderson would join Las Vegas in permitting to-go alcoholic drinks.
