LAS VEGAS, Nev. (FOX5) – A lawsuit has been filed against the Clark County School District over a student that was reportedly dropped off at the wrong bus stop.

Manuel Alejandro Gomez and Maria Jose Garcia Garcia filed the the lawsuit on behalf of their child. The student attended Howard Wasden Elementary School. On Aug. 14, 2023, the lawsuit says the student was in kindergarten.

The lawsuit says the student’s bad was tagged with a specific color to show which bus he needed to board. However, staff placed the him on the yellow bus when he should have been on red.

The student’s babysitter was at the bus stop, but the child reportedly never showed.

The lawsuit claims the bus driver did not report the possible missing child after the drop off. His parents and babysitter called the school and police to report the child missing.

Meanwhile, the student was dropped off at a location near the Siegel Suites on Martin Luther King Boulevard.

The lawsuit says the bus driver needs to see the students handed off to a parent, but this protocol was not followed.

It says the student was “alone and distressed,” and also “suffered emotional distress, mental anguish and suffering.”

An employee of the suites saw the child wandering and took him to the office to report him to police.

FOX5 reached out to the district for comment. They do not comment on pending litigation.
