LAS VEGAS (FOX5) — Lawyers for Duane “Keffe D” Davis asked Tuesday for charges related to the 1996 killing of rapper Tupac Shakur in Las Vegas to be dropped.

Davis’ legal counsel has asked the Nevada Supreme Court to dismiss the charges against him. They argue that prosecutors are relying on statements Davis made to law enforcement years ago, which they say were given under legal immunity.

Attorney Carl E.G. Arnold argued that using those statements violates Davis’ constitutional rights.

“Mr. Davis cooperated with law enforcement for more than a decade based on assurances that his statements wouldn’t be used against him,” Arnold said in a statement. “Those same statements are now central to the case against him. That’s a clear due process violation.”

Davis’ legal counsel said the Nevada Supreme Court is expected to review the petition, though no timeline has been announced for action. Davis remains in custody on charges related to Shakur’s death, with a trial set for 2026.
