LAS VEGAS, Nev. (FOX5) – The City of Las Vegas has asked the federal courts to dismiss a lawsuit that accuses its marshals of conducting illegal traffic stops. 

According to Court Documents the City of Las Vegas filed a motion to dismiss the case.

The lawsuit filed by Derek Meyers stems from a traffic stop in January on I-11 near Craig Road. 

During this stop, the lawsuit claims a marshal drew a handgun, made threats with a stun gun, and slammed him to the ground.

Meyers says they violated his civil rights. 

Marshals cited him for not stopping at a stop sign or emergency lights and obstructing and resisting. Downes-Covington would hire a private attorney and eventually have the charges dropped.

The plaintiff accuses the City of Las Vegas’ deputy marshals of negligent training and supervision, intentional infliction of emotional distress, battery and assault, false arrest and imprisonment, and violation of the constitution.

The plaintiff is seeking about $1 million for damages

The city contends marshals saw Meyers swerving, tailgating, speeding and driving recklessly, so they detained him because they suspected him of driving under the influence.
